Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed operational insights of his racing venture, saying he put in $40m of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I had no fear. I felt I could challenge Nascar in its entirety. I felt as far as the sport it needed to be looked at through a new lens.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other major leagues with separately owned franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar demanded teams renew their charters.
Jordan testified for an hour and left the court to pandemonium, with fans and media clamoring for a glimpse or a photo of the global icon.
Spearheading the Fight
Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.

Gibbs described a frantic and emotional six hours where the sanctioning body informed teams they had to sign a contract extension. This agreement spanned over a hundred pages detailing team compensation and a guaranteed entry in every race.
Choosing Litigation
Jordan explained that his team and its ally concluded their sole viable path was to decline to sign that extensive document and litigate the matter. The other 13 organizations agreed to the terms.
Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or extension options. Nascar refused to engage, Jordan said.
The Bottom Line: Winning
But in the end, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.
“Denny convinced me getting a third driver boosted our odds of winning,” he testified, noting that he bought a third charter last year for $28m despite the uncertainty. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the pressure of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
