A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the judge pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The court challenge center on conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.
